A lot has changed in the last week. I’ve been very frustrated by Pelosi’s reticence to proceed with a formal impeachment process, but in the final analysis I think her strategy has been validated. She kept handing Trump rope, and it appears that he finally hung himself with it. It’s going to be impossible to keep the IG complaint under wraps, his tax returns will be pried loose, and between court losses and leaks a lot more damning shit is going to come out.

just because a president (or AG) does something, doesnt necessarily make that a permanent precedent for all time.

this stuff isnt ‘law’.
it’s not stare decisis.
it’s convention.

just like that ‘cant indict’ DOJ memo, or frankly any counsel’s memo (john yoo torture). they are just opinions written to justify whatever they’re looking to do.

mueller couldnt dispute the memo from within doj. others could have.

They’re just not that smart.

Giuliani apparently wasn’t clear enough in his persuasion to Ukraine to do what Trump wanted, so Trump, who views himself as the great dealmaker, apparently had a conversation with the to try to get them to do what he wanted.

As I said before, I’m pretty sure there are some KGB officers who dreamed up this whole deal sitting at a desk in Moscow, banging their heads against their desks.

People in positions of power always need a cut-out, to prevent any blame from a deal from going bad from reaching back to them. For Trump to get involved himself is really, really dumb.

All versions of “if you do this, Republicans will be even angrier and more out of control” are horseshit.

First, over seventy years they’ve built up a culture of ressentiment that’s self-reinforcing—that wingnut base—such that the cultural narrative will always encourage feeling betrayed and lashing out. They accuse everyone else…Democrats, the world, gays, SOROS, any insider engaging in mild criticism…of perfidy and treachery, but their sense of entitlement to retaliation has no grounding in actual transgressions against them. Their position of “I had to do that, why did you make me do that?” is bad faith.

Second, both the ideologues…the religious nuts…and the cynics…the ones just looking for cash…have consistent pursued maximal abuse of power, limited only by what they can conceal or justify in their subcultural lexicon of tropes and affective bypasses…because they have to appease their base. We’ve seen this with scams that get soldiers killed, maimed, and abandonned; we’ve seen it with torture; we’ve seen it with erosion of civil liberties and expansion of the police state. Parallel with the paragraph above…their opportunism is not dependent on the choices of anyone else.

Third, from Reagan to W to Trump, a consistent feature has been contempt for the spirit of the law and the social contract in favor of a wheedling, to-the-letter exploitation of loopholes, and the use of institutional opaqueness to outright break the law. Contempt for social norms such as comity and basic etiquette has escalted decade after decade. Claims that everyone else must be polite, respect norms, respect the rules, must be viewed as bullshit, bad faith, or evidence of a fundamental lack of self-reflection that verges on narcissism.

Fourth, we are not in a situation where Republicans are self-policing abuse of power because of respect for institutions; proposals that “things will get worse if you impeachment” hinge on the pretense that the GOP isn’t alternately undermining the systems and passively allowing destabilization.

Over and over we are seeing versions of “you will be responsible for our bad behavior” and it’s bullshit.

And one other thing…if “optics” are so important that they supercede the law, fact-finding, and the clear pattern of consistent unethical goals and actions by a group in power…then our society is already broken and the sense that sustaining the status quo will result in better outcomes is built on nothing. If there is only the narrative that informs what is good optics, and the narrative is set by a small number of power brokers, then things can get worse at any moment, when the powerful change the narrative. The status quo continuing on, that the powerful people will continue to play somewhat-nice, is an illusion.

When these people say “the optics will be bad” the response is to repeat, over and over “the optics are bullshit that you made up.”

The crime was one thing. But they’re covering it up. Make them have to not only release the actual recording, but the complaints filed by the whistle blower and allow the House and Senate to having hearings with the employee. If it turns out to be nothing, then we ask why it took so much effort to get Trump to follow the law.

I’m glad that a formal impeachment inquiry is happening. That is an important first step. But now the question is: will this be a wide ranging inquiry or is it going to be limited to the Ukrainian influence story?

I hope it is wide ranging. I hope they include, at the very least, abuse of power articles related to the use of emergency powers to bypass congressional will. But deep down, I want 20+ articles of impeachment against this bastard. Throw the entire fucking book at him.

From what I remember seeing was that this was not just one call. It was several over a period of time. One call transcript doesn’t prove anything. So one call out of several has a pretty clean transcript, what about the others?
