Suppressing the story isn’t illegal. Paying to suppress the story isn’t illegal. They have to prove the intent was to interfere with the election and not just hide it from his wife or protect his business reputation or whatever. That is going to be the tricky part for the prosecution, unless he actually specifies his purpose on the recording.

deducting the payments for tax purposes regardless of the election effect/motive is illegal.
